Donation Agreement of the NPO Friede Allen e.V. (hereinafter referred to as the "Peace unto All" or ‘Mir Vsem’)

1. GENERAL PROVISIONS

1.1 This agreement on charitable donation to the project ‘Mir Vsem’ via the website https://mir-vsem.info/ (hereinafter the ‘Site’) is concluded between:

The Beneficiary, Mir Vsem Project (‘Mir Vsem’) and

The Benefactor (hereinafter referred to as the ‘Benefactor’), together referred to as the ‘Parties’, in respect of his donation to the ‘Mir Vsem’ project (hereinafter referred to as the ‘Donation Agreement’).

1.2 The Benefactor may be any person of legal capacity who has reached the age of majority.

1.3 Acceptance of the Donation Agreement by clicking on the ‘Donate’ button and/or ticking the checkbox and/or making a donation means the Charity's full consent to the terms and conditions of the Donation Agreement.

1.4. ‘Mir Vsem’ is ready to conclude donation agreements in a different order and (or) on different terms and conditions than stipulated by this Donation Agreement. To make a donation on other terms and conditions, the interested party may contact ‘Mir Vsem’ by e-mail: let.the.peace.be.unto.all@gmail.com.

2. CONDITIONS FOR MAKING A DONATION

2.1 As a voluntary charitable donation, the Benefactor transfers to Mir Vseem its own funds to Mir Vsem by any means available on the Website, and Mir Vsem accepts the charitable donation and undertakes to use it to realise the objectives of Mir Vsem's activities.

2.2 The Benefactor independently determines the amount of the donation.

2.3 The benefactor undertakes to use a payment method belonging to him/her (registered in his/her name).

2.4 Before making a donation, the Benefactor undertakes to enter his/her name and e-mail address on the donation page of the Website and accept the User Agreement and the Donation Agreement.

2.5 By making a donation, the Benefactor confirms that he/she has read the Privacy Policy and agrees that his/her data will be processed as specified in the Privacy Policy.

2.5 The Benefactor warrants that the donated funds belonged to him/her personally, were received by him/her in a lawful manner and he/she undertakes to confirm this fact at the first request of Mir Vsem.

2.5 The benefactor has the right to be informed about the use of his/her donation.

2.6 To cancel a subscription or request a refund, the Benefactor should send an email to let.the.peace.be.unto.all@gmail.com .

3. ACTIVITIES OF ‘PEACE UNTO ALL’

3.1. ‘Mir Vsem’ is engaged in the organisation of gratuitous assistance to ministers with an anti-war stance in Russia and abroad in accordance with the Statute of the NPO Friede Allen e.V. registered with the Court of Hamburg.

3.2 The activities of ‘Peace unto All’ are not intended to make profit.

3.3 The organisation publishes information about its work and reports on the results of its activities on the website https://mir-vsem.info.

3.4. Mir Vsem processes the personal data of the Benefactor as specified in the Privacy Policy.

4. APPLICABLE LAW AND DISPUTE RESOLUTION

4.1 All enquiries relating to the interpretation, validity and performance of this Agreement shall be governed by, construed and applied in accordance with the laws of the country where Mir Vsem is located (Federal Republic of Germany).

4.2 In case of any disagreements or disputes between the Parties, a claim (written proposal for voluntary dispute resolution) is a mandatory condition before resorting to court.

4.2.1 Claims to ‘Mir Vsem’ may be sent:

4.2.2 The recipient of the claim within 30 calendar days from the date of its receipt, shall notify the applicant of the claim in writing of the results of consideration of the claim.

4.3 If it is impossible to resolve the dispute voluntarily, any of the Parties shall have the right to apply for its resolution to the Local Court of Hamburg at the location of Mir Vsem.

4.4 If permitted by applicable law, the Benefactor agrees that it may only bring claims against Mir Vsem in its own name and not as a plaintiff or class member in any class action.

5. SEVERABILITY OF TERMS

If any provision of the Donation Agreement is held invalid or unenforceable under any law, act, regulation, or decision of a competent authority, then such provision shall be deemed modified or deleted, but only to the extent necessary to comply with such act, regulation, or decision, with the remaining provisions remaining in full force and effect.

6. MODIFICATION OF DONATION AGREEMENT

‘Peace to All’ may unilaterally amend the Donation Agreement without notice to the Charity. The current version will be published on the Website.
